It is the policy of Beach Gremlins Networks Inc., dba BarLink Online, and the BarLink website or related business operations (collectively, “BarLink”), to respect user privacy. BarLink Members, Locations (as defined in the BarLink Online Location Board Display Agreement), Advertisers (as defined in the BarLink Online Advertiser Campaign Agreement), and any other parties viewing or exposed to BarLink Location Boards and content, including unregistered users (collectively, “User(s)”), be it online, at physical Locations, or otherwise, hereby recognize that by using the BarLink website, services, features, content, applications or widgets offered by BarLink (collectively “BarLink System”), they acknowledge and accept the practices and policies outlined in this Privacy Policy.
Each time a User accesses the BarLink System, the then-current version of this Privacy Policy will apply. Accordingly, each time a User accesses the BarLink System, they should check the date of this Privacy Policy (which appears at the end) and review any changes since the last time the User accessed the BarLink System. For additional information, see the section below concerning Updates and Changes to Privacy Policy.
Scope: This Privacy Policy covers only BarLink’s use of personally identifiable information collected when Users interact with the BarLink System (collectively, “Personal Information”) and does not apply to or guarantee in any way the practices of third parties that may likewise interact with, or provide advertisements or links within, the BarLink System.
INFORMATION COLLECTION PRACTICES: Personal Information collected by BarLink enables Users to set up User Accounts and profiles that can be used to interact with other Users and participate in Location Boards. Consequently, the BarLink System will request and display some Personal Information to other Users. The BarLink System collects the following types of information from Users:
Information Provided By Users: The BarLink System receives and stores any Personal Information the User provides. The types of Personal Information collected may include but not be limited to User’s legal name, on-screen user name, email address, phone number, address, birth date, and other customizable information specific to the User. Location Account Users may also be requested to provide business information, such as but not limited to phone numbers, physical address, federal identification number, business email, owner name, and owner contact information. The Personal Information a User provides is used solely for the purpose of Users interacting with the BarLink System and improvements of the BarLink System.
Traffic Data: The BarLink System may automatically gather information of the sort that browser operations make available, including: (i) IP addresses; (ii) domain servers; (iii) types of computers accessing the BarLink System; and (iv) types of Web browsers accessing the BarLink System (collectively "Traffic Data").
Ad Serving: In some cases, the BarLink System may use third-parties for advertising and analytics. These third-parties may place cookies on User’s computer, use web beacons, gather IP addresses and log data to collect traffic and activity data in order to deliver relevant metrics, content, and advertising.
Cookies: A "Cookie" is a string of information that is stored on a User's computer, and that the User's browser provides to the BarLink System each time the User submits a query to the BarLink System. The purpose of a Cookie is to identify the User as a unique User of the BarLink System, for example to store and recall a User password so it need not be entered every time the User visits the BarLink System. The BarLink System may use Cookies, and other methods, to store and retrieve data from a User’s web browser.
Information Users Make Public. By registering with the BarLink System, User’s are required to create a personal profile, which may include Personal Information. Personal Information contained in personal profiles is available and accessible to all Users of the BarLink System. The BarLink System contains features that permit Users to upload, post, transmit, display, perform or distribute content, information or other, including User’s Personal Information. Any information that Users choose to disclose by means of such features becomes public information over which BarLink is unable to exercise control. Users should use caution when deciding to disclose Personal Information by means of such features, and Users agree to assume all responsibility for doing so.
INFORMATION USE AND DISCLOSURE PRACTICES
Traffic Data and Information Gathered Using Cookies: The BarLink System analyzes Traffic Data and information gathered using Cookies to better understand who is using the BarLink System and how it is being used. By identifying patterns and trends in usage, the BarLink System is able to improve User experience, and to serve User more relevant content. From time to time, BarLink may release Traffic Data and information gathered using Cookies in the aggregate, such as by publishing a report on trends in the usage of the BarLink System. BarLink does not attempt to link information gathered using Cookies to User’s Personal Information.
Personal Information: BarLink uses contact data to send information about the BarLink System and to contact Users when necessary in connection with the BarLink System. BarLink may employ User demographic data to customize and tailor User experience on the BarLink System. As with Traffic Data and information gathered using Cookies, from time to time BarLink may release demographic data in the aggregate, such as by publishing a report on trends in the usage of the BarLink System. In addition, BarLink may share demographic data with its Locations, Advertisers and other business partners.
Disclosure in Connection with Services: BarLink discloses Personal Information to those who help it provide services, including those who perform technical, administrative and data processing tasks such as, but not limited to, ad serving, hosting, billing, fulfillment, and data storage and security.
By Law or to Protect Rights: BarLink discloses Personal Information when required to do so by law, or in response to a subpoena or court order, or when BarLink believes in its sole discretion that disclosure is reasonably necessary to protect the property or rights of BarLink, third-parties, or the public at large.
Business Transfers; Bankruptcy. BarLink reserves the right to transfer all Personal Information in its possession to a successor organization in the event of a merger, acquisition, bankruptcy or other sale of all or a portion of BarLink’s assets. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred Personal Information will be subject to this Privacy Policy, or to a new privacy policy if Users are given notice of that new privacy policy and an opportunity to affirmatively opt-out of it. Personal Information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by a successor organization.
License to User Content. By using the BarLink System, Users grant BarLink the right to publish Personal Information in connection with BarLink’s exercise of their license in and to User Content (as defined in the BarLink Terms Of Service). Users further waive any claims arising from BarLink’s exercise of that right.
General Disclosure Practices: Except as otherwise provided in this Privacy Policy, and under the above described circumstances, BarLink will keep Personal Information private, and will not share it with third parties. BarLink will not share, rent, sell, or trade Personal Information (including e-mail addresses) identifying BarLink Users to third parties. BarLink will not share, rent, sell, or trade data contained in User accounts. BarLink has implemented and maintains reasonable security procedures and practices to protect against the unauthorized access, use, modification, destruction or disclosure of Personal Information.
Consent to Receive Communications from BarLink: By registering with the BarLink System, Users thereby consent to receive periodic email or SMS/text communications regarding the BarLink System, new product offers, promotions and other matters.
Consent to Receive Communications from other BarLink Users: By registering with the BarLink System, Users thereby consent to receive electronic communications, including email, SMS/text messages, and personal messages from other Users of the BarLink System.
Invitations: Users are given the opportunity to invite friends to the BarLink System. When a User invites someone to join the BarLink System, BarLink will disclose User’s real name within the invitation sent to the email address of the invitee so they know who has contacted them.
Deleting User Accounts: Users may delete their BarLink User account at any time by emailing This e-mail address is being protected from spambots. You need JavaScript enabled to view it , or by selecting the “Delete My BarLink Profile” option in the User’s profile view page. If a User terminates their account, the profile information, including any messages from other Users, will be removed from the BarLink System and deleted from BarLink’s servers, however, deletion of such data may not be immediate and residual copies may remain on backup media for a reasonable period of time.
Updates and Changes to this Privacy Policy: BarLink reserves the right, at any time and without notice, to add to, update, change or modify this Privacy Policy, simply by posting such update, change or modification on this page. Any such addition, update, change or modification will be effective immediately upon posting on the BarLink System. Unless BarLink obtains a User’s express consent, any revised Privacy Policy will apply only to information collected after the effective date of such revised Privacy Policy, and not to information collected under any earlier Privacy Policy.
